Barnesville Mayor’s Court

About

The Mayor has jurisdiction, subject to restrictions in the Ohio Revised Code, to conduct a Mayor’s Court to hear and determine any prosecution for the violation of an ordinance of the municipal corporation, any case involving a violation of a vehicle parking or standing ordinance of the municipal corporation and determine all criminal cases involving any moving traffic violation occurring on a state highway located within the boundaries of the municipal corporation. Mayor’s Court is not a court of record. Certain cases may be transferred to County Court as required by law or upon request.

Mayor's Court Date & Time

  • Court is held every other Monday at 4:00 PM.
  • Holiday Exception: If Monday is a holiday, court will be held the following Tuesday at 4:00 PM.

If You Received a Citation

Your assigned court date is listed at the top of your citation. You must either:

  • Pay the fine prior to your court date, or
  • Appear in Mayor’s Court on the scheduled date and time

Failure to pay or appear may result in additional court costs, license suspension, registration blocks, or the issuance of a warrant.

Minor Misdemeanor violations may be paid in person up to the assigned court date at 4:00 PM.

Proof of Insurance / Financial Responsibility

Under Ohio law, all drivers must provide proof of insurance upon request by a law enforcement officer. If you did not provide proof of coverage at the time of your traffic stop, you must submit documentation showing the vehicle was insured on the date/time of the offense.

How to Submit Proof

You can provide your proof of insurance (for the vehicle driven at the time of the citation) through any of the following methods:

  • In Person: Bring proof when paying your citation or attending your court appearance.

  • By Mail: Enclose a copy of your proof with your payment.

  • By Email: If paying online, look for a follow-up email from the Clerk of Courts requesting your documentation once payment has been received. You can also email proof to mayorscourt@barnesvilleohio.com.

Penalties for Non-Compliance

Failure to provide valid proof of insurance for the date and time of the offense will result in:

  1. Driver’s License Suspension: A mandatory suspension of your driving privileges for a period of not less than 90 days.

  2. Registration Suspension: Suspension of your vehicle registration through the Ohio Bureau of Motor Vehicles (BMV).

Check Your Driving Record

If you need to check your driving record for license suspensions, active points, or other status updates, visit the Ohio Bureau of Motor Vehicles (BMV) online portal.

The BMV website allows you to:

  • View active or pending license suspensions: Stay informed about your driving status and any legal requirements.

  • Check outstanding fees: View balances or reinstatement fees owed to the BMV.

  • Monitor license points: Keep track of your current point total to avoid future penalties.

  • Request an official copy: Obtain a certified copy of your driving record for employment or legal purposes.

Court Information

If you need to reschedule your hearing, you must submit a completed request to the Mayor’s Court Clerk before your scheduled court date. Please note that continuances are not guaranteed and are granted at the discretion of the Court.

Fees & Policy

  • First Request: One continuance is granted free of charge.

  • Subsequent Requests: Each additional continuance incurs a $15.00 fee added to your court costs.

You will be notified once a decision has been made regarding your request. You will then be provided information on your new court date and time.

The Court may allow a defendant to pay fines and court costs through a structured payment plan over a period of time.

Payment Plan Information:

  • Payment plans are available upon request.

  • A $25.00 payment plan fee will be added to the total court costs.

  • Failure to comply with the agreed payment schedule may result in additional penalties, including further action.

Defendants who wish to request a payment plan may either contact the Mayor’s Court Clerk to make arrangements or request a payment plan at the time of their scheduled court appearance.

If you fail to appear in court or fail to pay a waiverable fine by your assigned court date:

  • Your driver’s license may be suspended

  • A registration block may be placed on your vehicle

  • Additional court costs may be assessed

  • A warrant for arrest may be issued

Out-of-state license holders may be reported to their home state, and additional fees may apply.

Driving privileges will not be restored until all fines and court costs are paid in full and a release is issued by the Court.

All defendants have rights guaranteed by law. These rights will be explained to you during your arraignment. It is important that you understand them before entering any plea. Your Rights Include:

1. The Right to a Speedy Trial
The law requires the Court to bring your case to trial within 30 days of the date you were charged, unless you waive that right or request a continuance.

2. The Right to Know the Charges Against You
You have the right to know the nature of the charges filed against you, to read the complaint or citation, and to know the identity of the complainant.

3. The Right to an Attorney
You have the right to be represented by an attorney at all stages of the proceedings. You may request a reasonable continuance to obtain counsel.

4. The Right to Court-Appointed Counsel (When Applicable)
If the charge you are facing carries a possible jail sentence and you cannot afford to hire an attorney, the Court will appoint one for you at no cost.

5. The Right to a Jury Trial (When Applicable)
If the charge carries a possible jail sentence, you have the right to request a jury trial, as provided by law.

6. The Right to Remain Silent
You have the right to remain silent. Anything you say may be used against you in court.

7. The Right to Reasonable Bail
You have the right to remain free on reasonable bail while your case is pending, if applicable.

8. The Right to Know the Possible Penalties
You have the right to be informed of the maximum penalty you could receive if convicted. For traffic offenses, penalties may include fines, court costs, points on your driving record, and possible suspension of your driver’s license.

9. The Right to Appeal
You have the right to appeal the Court’s decision within ten (10) days, as provided by law.

10. Notice to Non-United States Citizens
If you are not a citizen of the United States, a conviction may result in deportation, denial of citizenship, or other immigration consequences under federal law

Plea Options

At arraignment, you may enter one of the following pleas:

  • Guilty: A complete admission of guilt

  • No Contest: Not an admission of guilt, but an admission of the facts alleged; cannot be used against you in a later civil or criminal proceeding

  • Not Guilty: Denial of guilt; your case will be transferred to Belmont County Western Division Court. Your trial will be scheduled at a later date

You are responsible for notifying the Mayor’s Court Clerk immediately if your address changes while your case is pending or while you are making payments on a fine. The Court sends notices and billing statements to the last address on file, typically the one that is wrote on your citation or summons. Please be aware that if a notice is returned by the Postal Service, you are still legally deemed to have received it. Failing to update your address may result in missed court dates or payment deadlines.
